第一条 为保护基本农田,稳定基本农田面积,提高基本农田质量,促进农业生产和国民经济的发展,根据《中华人民共和国土地管理法》、《中华人民共和国农业法》、《基本农田保护条例》和《吉林省基本农田保护条例》等有关法律、法规,结合本市实际,制定本条例。
第二条 本条例所称基本农田,是指根据一定时期人口和国民经济对农产品的需求以及对建设用地的预测而确定的长期不得占用的和基本农田保护区规划期内不得占用的耕地。
本条例所称基本农田保护区,是指为对基本农田实行特殊保护而依照法定程序划定的区域。
第三条 本条例适用于本市行政区域内基本农田的保护和管理。
第四条 基本农田保护应当贯彻全面规划、合理利用、用养结合、严格管理的方针。
各级人民政府应当将基本农田保护工作纳入国民经济和社会发展计划,实行目标责任制管理。
第五条 市、县(市)、区人民政府土地行政主管部门和农业行政主管部门负责本行政区域内基本农田保护管理工作。
土地行政主管部门负责本行政区域内基本农田保护区的划定、调整,占用基本农田的审查报批,使用基本农田的监督等保护工作的统一管理。
农业行政主管部门负责本行政区域内基本农田的养护,质量监督,农业生态环境的保护、监测等管理工作。
计划、城建、环保、财政等有关部门按照各自工作职责,配合同级土地、农业行政主管部门做好基本农田保护的有关工作。
乡(镇)人民政府按照本条例的规定,组织农村集体土地所有者和承包经营者,建设、保护和合理利用基本农田。
第六条 一切单位和个人都有保护基本农田的义务,并有权对侵占、破坏基本农田以及违反本条例的行为进行检举和控告。
第七条 基本农田保护区的规划,应当根据本行政区域土地资源、人口状况、经济发展和城镇建设的需要,统筹兼顾农业用地和非农业建设用地,以土地利用总体规划、农业资源调查区划为依据,并与城市规划和村镇建设规划相协调。
第八条 市、县(市)、区人民政府土地行政主管部门和农业行政主管部门应会同其他有关部门根据上一级人民政府基本农田保护区规划,编制本行政区的基本农田保护区规划,经本级人民政府审定,报上一级人民政府批准。
第九条 下列耕地应划入基本农田保护区:
(一)国务院有关主管部门和县级以上地方人民政府批准的粮、油和名、优、特、新农产品生产基地;
(二)高产、稳定田和有良好的水利与水土保护设施的耕地以及经过治理、改造和正在实施改造计划的中低产田;
(三)县级以上人民政府确定的蔬菜生产基地;
(四)农业科研、教学试验田;
(五)农作物良种繁育基地。
第十条 划入基本农田保护区的耕地分为以下两级。
下列耕地为一级基本农田:
(一)生产条件好、产量高、长期不得占用的耕地;
(二)粮、油和名、优、特、新农产品及蔬菜生产基地;
(三)农业科研、教学试验田;
(四)农作物良种繁育基地。
下列耕地为二级基本农田:
(一)生产条件较好、产量较高,规划期内不得占用的耕地;
(二)改造和正在实施改造计划的中低产田等。
第十一条 对基本农田保护面积实行指标控制,并逐级分解下达。
市人民政府根据本市基本农田控制指标,确定各县(市)、区基本农田保护的数量指标和布局安排计划。
县(市)、区、乡(镇)人民政府具体负责落实基本农田的保护区、保护地块、保护面积,并登记造册建立档案。
第十二条 基本农田保护区的划区定界工作,以乡(镇)为单位进行,由县级人民政府土地行政主管部门会同农业行政主管部门组织实施。
第十三条 划定的基本农田保护区由上一级人民政府组织验收。
划定的基本农田保护区由县级人民政府设立标志,并予以公告。
任何单位和个人不得损毁基本农田保护区标志。
第十四条 划定基本农田保护区时,不得擅自改变原承包者的承包经营权。
第十五条 基本农田的土地所有者和承包经营者应遵守下列规定,保护和合理利用基本农田。
(一)加强农田基本建设,改善生产条件,防止水土流失;
(二)增施有机肥料,科学施用化肥,合理耕作,防止地力衰退;
(三)合理施用农药,改善生态环境,防止土壤污染。
第十六条 经批准划定的基本农田保护区、保护地块和保护面积,不得擅自更改,确需改变时,必须报原批准机关批准。
第十七条 在已划定的基本农田保护区内,因特殊情况确需设立开发区的,有关单位申报时,必须附具省以上人民政府土地管理部门和农业行政主管部门的意见。
第十八条 非农业建设占用基本农田实行申报制度。
非农业建设项目确需占用基本农田的,建设用地单位和个人应当向市、县级人民政府土地行政主管部门领取并填写《基本农田占用许可证申请表》,经市、县级农业或者蔬菜行政主管部门同意后,持建设项目的批准文件到市土地行政主管部门办理《基本农田占用许可证》,按有关规定
程序和审批权限办理建设用地手续。
(一)占用一级基本农田的需报省以上人民政府批准;
(二)占用二级基本农田3亩(不含三亩)以下的由市人民政府批准,3亩以上的由省以上人民政府批准。
第十九条 非农业建设占用基本农田的,除应依法缴纳有关税费外,还应按照“占多少、垦多少”的原则,由用地者负责开垦与所占耕地数量和质量相当的耕地。没有条件开垦或者开垦的耕地不符合要求的,必须按土地审批权限向土地行政主管部门缴纳、补足基本农田保护区耕地造地
费。占用基本农田保护区内的菜地,已按规定缴纳新菜田开发建设基金的,免缴占用基本农田保护区耕地造地费。
第二十条 基本农田保护区耕地造地费和新菜田开发建设基金按以下标准收取:
(一)一级基本农田为该地被征用前三年平均年产值的13-15倍;
(二)二级基本农田为该地被征用前三年平均年产值的10-12倍;
(三)新菜田开发建设基金为该地被征用前三年平均年产值的12-14倍。
基本农田保护区耕地造地费和新菜田开发建设基金必须实行专户存储、专款专用,用于新的基本农田开垦、中低产田的改造和新菜田的开发建设,任何单位和个人不得挤占、挪用。
第二十一条 各级人民政府应当组织新的基本农田开发建设,逐年增加对基本农田资金投入,除造地费和新菜田开发建设基金外,耕地占用税和不低于10%的占用基本农田的非农业建设用地出让金均应用于新的基本农田开发建设和保护。
第二十二条 村镇建设应在预留地内进行,不得占用基本农田。
第二十三条 基本农田保护区内禁止下列行为:
(一)倾倒垃圾、排放有毒、有害的液体及堆放固体废弃物;
(二)建窑、建房、建坟,擅自挖砂、取土、采矿、采石;
(三)将耕地转为非耕地;
(四)其它破坏基本农田的行为。
第二十四条 禁止任何单位和个人闲置、荒芜基本农田保护区的耕地。
已办理占用基本农田审批手续的,一年内不用而又可以耕种并收获的,应由原耕种的集体或个人征得用地单位的同意继续耕种,也可由用地单位组织耕种;未耕种的,由用地单位按规定交纳闲置费。一年以上未动工兴建而闲置的,按规定缴纳闲置费。未经原批准机关同意,连续二年未
用的,由土地行政主管部门报县级以上人民政府批准收回用地单位的土地使用权,注销土地使用证。
第二十五条 市、县(市)、区人民政府应对在基本农田保护工作中取得显著成绩的单位和个人,给予表彰或奖励。
第二十六条 违反本条例的,由土地行政主管部门或者会同有关部门按下列规定予以处罚,构成犯罪的,依法追究刑事责任。
(一)违反第十三条第三款规定,损毁基本农田保护区标志的,责令恢复原状,并处以200元至500元罚款。
(二)违反第十八条规定,未经批准占用基本农田的,责令退还非法占用的土地,恢复原种植条件,限期拆除在非法占用的土地上新建的建筑物和其他设施,并按有关法律、法规规定给予处罚,对直接责任者和主管领导给予行政处分。
(三)违反第二十条第二款规定,挤占、挪用基本农田造地费的,责令其退赔,并处以占用款一至三倍的罚款,对直接责任者和主管领导给予行政处分。
(四)违反第二十三条第一项规定,向基本农田倾倒垃圾、排放有毒、有害物质和堆放固体废弃物的,由环境保护、农业行政主管部门按环境保护法律、法规的有关规定处罚。
(五)违反第二十三条第二项规定,在基本农田从事建窑、建房、建坟和擅自挖砂、取土、采矿、采石等非农业生产活动的,没收非法所得,责令拆除其非法建筑,退还非法占用的耕地,恢复原种植条件,并处以每平方米10元至15元的罚款。
(六)违反第二十三条第三项规定,将耕地改为非耕地的,责令其恢复原种植条件,并处以占用耕地每平方米15元罚款,对直接责任者和主管领导给予行政处分。
(七)违反第二十三条第四项规定,有其它破坏基本农田行为的,除恢复原种植条件外,并按有关法律、法规法定给予处罚。
第二十七条 拒绝、阻碍基本农田管理人员依法执行公务的,由公安机关依据《中华人民共和国治安管理处罚条例》予以处罚;构成犯罪的,依法追究刑事责任。
第二十八条 有关领导和基本农田管理工作人员玩忽职守、滥用职权、徇私舞弊的,由其所在单位或者上级主管机关、行政监察机关给予行政处分;构成犯罪的,依法追究刑事责任。
第二十九条 当事人对行政处罚决定不服的,可以在接到处罚通知之日起十五日内向作出处罚决定机关的上一级机关申请复议或向人民法院起诉。当事人逾期不申请复议,也不向人民法院起诉,又不履行行政处罚决定的,由作出处罚决定的机关申请人民法院强制执行。
第三十条 本条例由吉林市人大常委会负责解释。
第三十一条 吉林市人民政府可根据本条例制定实施细则。
第三十二条 本条例自公布之日起施行。

PART I PRELIMINARY

PART II INCORPORATION AND POWERS
ncorporation of Consumer Council
The Consumer Council existing at the commencement of this
Ordinance is

The Governor may be notice in writing to the Council

In subsection (1) and in section 5 (2) (c) "goods and services"

The Council shall consist of the following members--
a Chairman who shall be appointed by the Governor for a

The Chairman, Vice-Chairman and any other member

Appointment of staff and advisers
Subject to subsection (4), the Council shall appoint a person to

PART III FINANCIAL
Resources of Council
The Governor may, out of money appropriated for the purpose

money paid to the Council by way of donations, fees,
subscriptions,

all other money and property, including accumulations of

Council may, with the approval of the Financial Secretary,

The Council shall keep proper accounts and proper records in

PART IV GENERAL
Council not servant or agent of Crown
Council is not a servant or agent of the Crown and does not enjoy
any
us, immunity or privilege of the Crown.
Governor may give directions
The Governor may, if he considers that the public
interest so
ires, give to the Council such directions as he thinks

ect to the exercise and performance by the Council of its
powers,
tions and duties under this Ordinance, either generally or
in any

The Council shall comply with any direction given to
it under
ection (1).
Protection of members of Council and committees
No member or employee of the Council or of any committee
of the
cil shall be personally liable for any act done or default made--
by the Council; or
by any committee of the Council, acting in good faith in the course
of
operations of the Council or of the committee.
The protection hereby conferred on members and employees
of the
cil or of a committee in respect of any act or default shall not
in
way affect any liability of the Council for that act or default.
Prohibition of exploitation of the Council's name for
advertisement
oses
No person shall, with a view to promoting or disparaging any
s, services or immovable property or promoting the image
of any
on, publish or cause to be published any advertisement which
either
essly or by implication makes reference to--
the Council;
any committee, member, agent or employee of the Council;
the Council's publication or finding of tests or surveys
conducted by
n behalf of the Council; or
any other information published by the Council, without
written
ent of the Council.
Any person who contravenes subsection (1) commits an offence
and is
le to a fine of $ 100,000.
For the purpose of subsection (1) "advertisement" may be
constituted
ny words, whether written or spoken, or any picture, drawing,

appearing in any publication; or
brought to the notice of the public or any section of the public

Transitional provisions
All property of whatever kind and whether movable or immovable
vested
r belonging to the Consumer Council existing at the
commencement of
Ordinance shall as from that date vest in or belong to that
Council
ts corporate capacity without any further assurance.
All obligations and liabilities of the said Consumer Council
are as
the commencement of this Ordinance the obligations and
liabilities of
Council in its corporate capacity.
Where anything has been commenced by or under the authority
of the
Consumer Council before the commencement of this Ordinance such
thing
be carried on any completed by the Council in its corporate
capacity.
Every person who immediately before the commencement of this
Ordinance
s an appointment as Chairman, Executive Director or a member of
the
Consumer Council is, as from such commencement but subject to
the
s of his appointment, the Chairman, Executive Director, or a
member of
Council, as the case may be, for the purposes of this Ordinance.
Notwithstanding the definition of "financial year" in section
2 the
